Contractor problem - help! Advice?

So we got this contractor through Service Magic for tile work and remodeling our bathroom (replacing cabinet, toilet, mirror, lighting, plumbing related to sink and tub). We... show more So we got this contractor through Service Magic for tile work and remodeling our bathroom (replacing cabinet, toilet, mirror, lighting, plumbing related to sink and tub). We purchased all the materials. The contract was for $2600, with 1/2 upfront. We paid the 1/2, then as it was progressing another $700. We provided a design. However, we noticed that the tile work was crooked, unleveled, both on the floor and tub wall. We pointed this out to the foreman and to the owner before he continued with the rest of the work. They came & inspected and agreed it should be redone, and would pay for materials, since tile was cut wrong, and it had to cracked to fix it. He didn't know why an uneven amt of grout was added, and claimed there was a problem with the subfloor. The prior tile came off easily and had no indentations on subfloor. Contract stated they would relevel any issues, which was not the case. However the next day, the owner responds saying we should find someone else to fix
Update: and complete the project. Everything is poor quality, all the tile in the tub too is bad, with indentations, and tile sticking out. grout lines crooked etc. We've asked Service Magic to help resolve the issue to no fair resolution. The only item we agree we should pay is for a tub reglaze of $350, and for him to refund us the $ for having to hire someone else to "redo" the work. Someone can't fix areas of tile here and there! So in total he itemized $400 for floor tile, and $1250 for tub tile & 350 for reglaze. We're asking for $600 for materials repurchase. for a total of $2200. He now says he needs to charge for trash rehaul of $400 (never itemized in contract) & cement backerboard $400. and only a refund to us of $700. This is unacceptable to us, b/c we had to buy all new material $600 and hired someone new to redo all the work $2500. It has been 3 mos w/o a bathroom. What rights do we have? Service Magic is useless. BBB? Small claims court? We've pics and emails.
