can an apartment complex hold someone to a lease agreement if tenant has never moved in?
My daughter sighned a lease agreement with an apartment complex but is unable to move in- no money ever was paid- deposit ect.. and she was not given a copy of the lease agreement- complex says it wants 100 dollars and to pay the rent until the apartment is rented- can they do this? How would you ever know if the place was rented or not, they could rent it the next day and take rent money from my daughter and you would never know the truth or not!!

she signed a legal contract. All she needed to do was to send a fax within 24 hours to withdraw. The complex has the right to charge a fee for breaking the lease and now they have to re-advertise and re-rent it. It is unfortunate but l suggest you are very nice and apologize for the mix up and see if they will give you a break, or at least let you know what happens.
