In the State of Texas prostitution is a Class B misdemeanor. A class B Misdemeanor carries with it a punishment of 0-180 days in the county jail and a fine not to exceed $2,000. Of course this does not mean that a person would serve 0-180 days in the county jail, options such as straight probation, deferred adjudication probation and pre-trial diversion are almost always available.
If however an individual has already been convicted of prostitution one or two times (thats the actual statutory language) then the offense MAY be charged as a Class A misdemeanor which carries with it a punishment of 0-365 days in jail and/or a fine not to exceed $4,000.
If a person has three prior conviction, not arrests but convictions, then they MAY be charged with a State Jail Felony which carries with it a penalty range of 6 months to 24 months of incarceration in a state jail facility and a fine not to exceed $10,000.
In Texas, section 43.02 defines prostitution and and its punishments and you should note that according to this provision the punishment is the same for the prostitute and the "john". So, statutorily there is no difference betwen the punishment for a prostitute and a "john".
However, here in the real world, the male "joihns" are rarely prosecuted or arrested for their behavior, unless of course the hooker and the john are both male, in which case both parties will probably be arrested and prosecuted. Other than those cases its usually just the prostitute who makes an appearance downtown in the jail and courthouse.

Prostitutes get a night in jail, johns get arrested and suffer the embarrassment for being immoral. After several arrests a prostitute might get a longer sentence, public nuisance , repeat offender etc.
