I'm going to say no the passenger can't be a witness because the passenger can be your friend and just go along with your story because you're friends. For example a reason why maybe the passenger can't be a witness is...you may not like somebody and have your passenger/friend say they did it to get that person in trouble.

IF HE WAS IN THE CAR WITH YOU, NO HE CANT BE A WITNESS. BECAUSE HES A VICTIM. BUT IF HE SAYS HE SAW THE TAG, WHAT MORE DO U NEED. WAS THAT TAG NUMBER GIVEN TO THE POLICE AT THE TIME OF REPORT?

I think they are looking for a independant witness, that is someone who is not known to you,the insurance companies can be suspicious of friends being witnesses due to it being easy to collaborate a false story with someone you know(i'm not suggesting you're doing this).

If he is your only witness, he's your witness. Get him to make a written statement, signed in front of a JP or equivalent. Report it to the Police and then get a copy of the police statement you made and the signed statement of your friend and give these to your insurance company.

I may depend upon which country we are talking about.

In the United States the passengers of both cars involved can be witnesses.

    Be persistent and Good Luck.

Yes, he can be a witness, but you need at least two other people to back him up.
