Statute of Limitations

States have varying amounts of time allowed between the time of an accident and when a suit must be filed, the statutes that govern this time period are called “Statutes of Limitations.” For simple negligence action, that time period averages about two to three years; however, some states have variations of those time period. Certain categories of claims such as property damage have longer statutes of limitations than do personal injuries, wrongful death, or libel.

Example: If a man is injured in an accident on July 1, 1990, and attempts to file a suit on August 12, 1992, he would not be able to sue. Indian has a two-year statute of limitation and the time period between the accident and the filing exceeded two years.

A child can wait until he or she has reached majority before filing a suit. The parents may sue on behalf of the child prior to the child reaching the age of majority. If the suit is pursued by the parents, the child may not file an additional suit after he/she reaches the age of majority.
