First Amendment and Casino Gambling?
Can someone please explain to me exactly how the First Amendment ties in with casino gambling? Thank you. =]

It seems that the only way it ties in is the Free Speech portion of the amendment.
Whether the goverment can regulate commercial speech has been discussed in the courts for a long time. Until around 1970, the first amendment wasn't extended to commercial speech, so the government could regulate all advertisements, ect. After then, the goverment slowly started to get challenges on regulations of commercial speech. In 1986 the United States Supreme Court upheld a Puerto Rico law prohibiting the advertising of casino gaming. (Posadas de Puerto Rico Associates v. Tourism Co. of Puerto Rico) In 1996, the Court ruled on (44 Liquormart, Inc. v. Rhode Island, Inc) which struck down a regulation preventing commercial speech that sold alcohol. Rejecting the Court's previous argument that speech selling 'vices' could be regulated. (Greater New Orleans Broadcasting Association, Inc. v. United States) was a Supreme Court case in 1999, where the Louisiana goverment was trying to restrict gambling advertisements. The court said that speech promoting gambling cannot be restricted in a state where gambling is legal.Source(s): firstamendmentcenter.org
