how do you go after a dishonest contractor?

he installed new tub and shower unit, did not put any concrete under it, scratched and goudged the walls and the 130 year old wood work, left gaps at both ends of tub, took off without a finish inspection and wont come back. says he did no damage. we payed him roughly one fourth and are refusing to pay more until he finishes the job right and repairs the damage. just refinishing the plaster wall and wood work will be $470.00 plus the cost of a painter will be another two or three hundred. we only owe him about 750.00 he refuses to provide his license and contractor numbers. he filed mechanics lean on the property, we tried to get him into court and the judge would not hear the case as the house is not up for forclosure. seems iowa courts only protect the buisness owners and not the consumer. he can file lean for unfinished work and damage he left with no written contract, but i cant do the same to him for the damage. how do i go after him and the old buddy court of cass county iowa?

    If he filed a lien on the property, he DID provide his contractor number to do that. The clerk of courts, or whoever records the lien MUST release that information to you. If you are having trouble filing a case, you may need an attorney to assist you. The court CAN'T refuse to hear a PROPERLY filed case on the grounds you listed.

    I had a similar problem here in Iowa with an automotive dealer. I bought a used truck from him and everything looked great. Aweek later everything was going wrong. They had the vehicle inspection law then, I took it back to him ( you have to give them some sort of chance to correct the problem) he worked on it ( put a used transfer case in it that was worse than the original and tried to charge me $600.00. I wrote him a check to release my truck, went to the bank and canceled it and then took it to a reputable dealer to get it fixed. It cost me app. $1200.00 for everything. I then took it to vehicle inpection station and had them check it out. Then turned around and sued him in small claims court for the price of correcting his mistakes. I won and he had to pay the difference. I also turned him into Ia. state patrol for vehicle inspection fruad. Small laims court should work in Iowa

    You need to document everything before you go off finishing the work. You need to take picture of everything that was so so finished. Then get all the quotes together and document that as well when you go into contract to finish what was not finished. Next report him to the BBB and your local city, or what ever city he is out of as well.

    As they said in the old days, black list him. Never bad mouth him/her unless you are showing other of his work. IE here is a photo of this person work and what they did to my house!

    A lot of local news programs have a section in the news where they go after stuff like this. In the Detroit area we have Ruth to the Rescue and Fox 2 Problem Solvers. See if your local news offers this type of thing.
