    We would have to know your State to give you a definitive answer on the time in which charges have to be filed. However, if there was an arrest without a warrant, a judge has to make a finding of probable cause to believe the person committed a criminal offense within 48 hours of arrest, including weekends and holidays. (County of Riverside v. McLaughlin (1991) 500 U.S. 44.)

    In Oregon you have 48 hrs in business days to file charges if the defendant is is in custody but it varies from state to state.
