It depends on your ethnicity and that of your judge or jurors. At very least, you'll loose your license. If your ethnicity's don't match or correspond, you could very well lose more than your license.
Just tell your testicles to thank God you're not a black or Hispanic with a white redneck judge in Texas. In the rest of the south, your testicles might survive, but your young virgin @$$ might not survive jail. If you were in the pantie waste liberal Northeast, they'd probably give you a medal for your courage for surviving and accepting your faults.
Either way, enroll in AA or treatment program prior to your hearing, and you might survive in CA. But do us all a favor, if you find yourself in a similar situation in the future, do us all a favor and put a bullet through your brain instead.

It depends upon how overzealous the prosecutor is. I have seen this charged as felony child endangerment (likely to cause great bodily injury, Pen. Code sec. 273a(a)), and the maximum punishment is six years in prison. I have seen it charged as misdemeanor child endangerment (not likely to cause GBI, sec. 273a(b)), and the maximum punishment is six months in jail.
What I have NOT seen is anybody convicted of violating Section 273a merely for being DUI with a child in the car. However, the charge could stick if the circumstances were more aggravated, such as if an accident was involved, or reckless driving, etc.Source(s): 30 years as a criminal defense attorney.

whatever the punishment is it would be nothing next to what you will face if your child dies at your hands while you are drunk driving.i am not putting you down. this is what i thought of when i read your question.everyday people put their lives and the lives of others in their hands when they drink and drive.just stop doing it. the worst punishment of all is what you will feel if your child dies or is permanently and forever injured because you didn't protect your child from yourself.don't drink and drive. you see the news and the stories. what are you thinking.in many states the child protective services are called and they will investigate and at the scene while they take you to jail, your innocent child is taken to a foster home.visualize that next time you feel like having a drink while you are with your child.it may help you to stop drinking
while you have your child with you.i am not sure really if you are inquiring because you got a dui with your child or the childs mom got a dui with a child or if you are just wondering for future reference. don't do it. every child deserves better.

If it is the first offense, I would assume CPS would be involved. If no prior history w/law enforcement or CPS, you will probably be looking at a fine, formal probation, possibly some jail time, a hefty fine, possible CPS involvement while on probation and DUI School. Hopefully, this is your first and ONLY time doing this. The entire matter causes financial burden, embarrassment, public ridicule and the possibility of jail time. First and foremost however is the obvious, the safety of the child. Count your blessings and please pay attention, as you may not be as lucky should you make such a poor choice in the future ~ Be Safe....&....Good Luck~
