    If you are here illegally,you cannot gain legal status from inside the country. The petition that was filed for you by your step father is no longer valid since it wasn't followed through. Your husband can petition for you,but when the time comes for your interview,you will have to return to your home country for an interview. At that point you will be denied a visa because you chose to remain here illegally as an adult. You will also be give a 10 year ban on returning. Your husband can then file a waiver for the denial and the ban but there is no guarantee it will be approved. You will have to wait in your home country until the ban has been approved and you are allowed to return legally. This could take up to a year. Marriage and a child does not change the situation.

    Welcome to Amerika . If not for the Military Commissions Act and the Patriot Act , you would at least have an idea where he is . They can do anything they want with him now . He may very well surface again in his country of origin . As much as that makes some people on this board happy , they wont be so happy when they come for someone they love or even themselves next .

    Contact an immigration attorney and give them all your brother's identifying information and tell them what's happened.

    Immigration doesn't take people anymore, you must be mistaken. Check Las Vegas.

    Was he illegal? If yes, I'm glad they took him. He's breaking the law and shouldn't be here!!!!
