if you are both on the lease agreement together you both have equal rights and would have to be decided between you 2 or the police. If you signed a sublease agreement from him then he can kick you out. He does not have seniority.

Since you are both on the agreement it doesn't matter who wants to leave. If he doesn't pay, you will be expected to pay. If he wants to kick you out or vice versa, he can't because you are on the lease. You have just as much right as him to stay.

If you guys can't get along, take your things, and go- BUT.....
here's the catch...You are liable for half of the rent, for the term specified.
