i moved with my boyfriend in the same apartment.he was the first to sign the lease and after 2 weekes i signed too.so, because he was the first, i bealive he has more rights.i want to know if we get into a fight, can he kick me out of the apt?can i kick him out?or, if we decide we dont get along toghether, both of us have to agree who is leaving and who is stayng?

    if you are both on the lease agreement together you both have equal rights and would have to be decided between you 2 or the police. If you signed a sublease agreement from him then he can kick you out. He does not have seniority.

    Depends on the contract stated in the lease. Usually it is equal rights and if you 2 can not agree on whom should leave, the situation will be deliberated inside a court.

    Since you are both on the agreement it doesn't matter who wants to leave. If he doesn't pay, you will be expected to pay. If he wants to kick you out or vice versa, he can't because you are on the lease. You have just as much right as him to stay.

    If you guys can't get along, take your things, and go- BUT.....

    here's the catch...You are liable for half of the rent, for the term specified.

    I had a roomie that left me holding the bag, and I had to pay the whole thing. It was well worth it, to have his nasty whore butt outta there!
