Can Google, for example, penalize you?

    Yes it is. Sitemaps are just a convinient

    shortcut to areas of your page. With some

    pages they wouldn't even make sense.

    No, they can't. But Google reads the actual pages, not just the sitemap or the META tags. Which is why it's so popular.

    You decide what it's public and what not.

    As with search engines you can manipulate the robots.txt file on your root directory. This way you can decide what can be crawled and what not.

    Sure you can, just make sure all your visible pages link back to yrou home page and other pages
