As stated previously, thru a state agency. You can obtain a fictitious name certificate for trade/banking purposes, or you can block the use of the name. However, in PA for example, the name will not be blocked from use by others unless you are a corporation. So make sure you ask if this is important to you.
Some states have websites where you can check to see if a name you want to use is in use by someone else.

If you're in the US, you'll need to do this through your states Secretary of State. You may even be able to do this online, depending on their website.
