However, as we move more to an intangible economy, we increasingly will witness “phantom immigration.” In other words, the visa or work permit system designed to limit the number of people from different countries entering another one will have little effect, especially with products such as software. Just think about how many people, particularly in offshore software havens such as Bangalore, India, and Shanghai, China are effectively participating in the U.S. economy without ever setting foot inside its legal tax jurisdiction.

But even at the most simple level, one must begin to question the ability of a country to tax in such a borderless world, where economic value is increasingly consumed within the legal tax jurisdiction but is actually purchased outside the legal physical boundaries of a country or state. Indeed, reports in England have suggested that e-commerce may reduce value-added tax revenue by up to 20%, or almost $16 billion per annum (Financial Times, 1999).
