Sexual Discrimination in the form of Birth Control：
How many times have you wished that your birth control prescription was covered by your company's health plan? I for one got quite sick of paying that $25 monthly bill and actually looked forward to my annual ob-gyn appointment because they would give me a few samples for free!
In a recent decision, a federal district court ruled that employers must include prescription contraception in its health plan. The case was Erickson v. Bartell Drug Co. and the conclusion will have women cheering the country over.
Jennifer Erickson, 27, filed the lawsuit in Seattle Washington against her employer, Bartell Drugs, because they did not cover birth control in their health plan. U.S. District Judge Robert Lasnik agreed with her and found that Bartell's plan "excludes prescription contraceptives from a generally comprehensive insurance policy [which] constitutes sex discrimination under Title VII because the employers 'have circumscribed the treatment options available to women, but not to men.' This unequal employment practice under Title VII of the Civil Rights Act of 1964."
In December of last year the Equal Employment Opportunity Commission determined that it was illegal to exclude contraceptives from their health insurance plans if they covered other preventive treatments, but the Erickson v. Bartell Drug is the first ruling that states that employees need to cover contraception period. Whereas the ruling by the EEOC was based upon the 1978 Pregnancy Discrimination Act, this case is a violation of the Civil Rights Act.
