In Jude 9, why couldn't Michael the Archangel make a judgement against the Devil?

9 Not even the archangel[a] Michael, when he argued with the devil about who would have the body of Moses, dared to judge the devil guilty. Instead, he said, "The Lord punish you."

So if he said the Lord/Jehovah God would do the rebuking, how can he be equal with God and the same?
