Police, The law, Over Reaction and Legal Aid Guilty or Not?
I was recently having a argument with my wife when the lovely neighbour next door called the police.
By the time the Police had arrived ( all 6 of them) we were sat down and all chilled out and actually very happy.
Before we knew it the house was stormed by these 6 officers after we opened the door to them. They seperated me and my wife to find out what was happening. Me in the Kitchen my wife in the lounge.
Before I knew it there was a scream from my wife,SHE was being arrested so I attempted to see what was happening when the PC in the kitchen with me struck me around the neck to stop me going to see her.
I attempted to push him out of the way ( which now is assault!) to which I was met by 4 officers elbow stiking me on the floor, I would not give them my arms to hand cuff me as I wanted to be with my 3 girls in the house.
Luckily one of my mates a Police Officer witnessed this him self, and managed to calm it all down he was off duty and just came round to see us!
Eventually I gave up and we were taken to a local police station 30 miles away.
Upon arrival at the station they took me out of the van undid my handcuffs and let us have a cigarette and a cuddle with my wife. We was both then breathalized and both under, fit for interview.
I was introduced to the custody officer where she clearly asked this PC was there any assault by me. He stated"NO ASSAULT".
My wife was interviewed first, 4 mins long! given a £80.00 fine and then to her amasement with out any notice, placed back in a police cell for a total of at least 1 hour.!
PLEASE ADVICE ME IS THIS LEGAL PRATICE.
I was then interviewed and I asked for a Solicitor, they advised me that I would be here all night if I wanted one so I didn't get one.
Finally after my interview which I admitted resisting arrest, even though the PC admitted I was not under arrest when he struck me!
I was then told to go home and wait for aa CPS decision.
Before I knew it the papers arrived, I was being charged with Assault PC ( A Push) can this with hold in court after he admits he struck me first.
So I went to the local solicitor and applied for legal aid, I was turned down .
Surely this is unfair to the working people out their, If you are a druggy you get legal aid straight away.........Is this discrimination.
I pleaded not guilty at the first hearing but know I believe I have no chance of a fair legal battle with out a Solicitor.
I have written to the CPS to change my decision from not guilty to guilty.what do you think.
1. Am I right to change my decision as I have been in trouble about 6 years ago for Drink related issues./
2.Do I have a chance if I take them on, I have a video from when I went in stating that I did not assault this PC.
3.Do you know any trainee lawyers out there willing to help.and with hold the law.
4.Is the Legal Aid System Fair.
5. Do the police do a good job in your area.
