Do you need a data plan for the fuze?

I want to get an HTC Fuze, but I can't upgrade yet, and i war wondering if i would be able to get a Fuze off of Craigslist and just pop in my sim card. Please answer

about 2 months ago all smart phones on AT&T are required to have data...
since you will be getting it from craigslist then yeah you can just pop in the sim and it will work.no data needed since you didnt get it from AT&T

you can do that but as soon as the system detects a smart phone on the line it will add the data plan auto.
