Nah, it's not illegal as long as you don't use any characters or ideas lifted directly from Harry Potter. I mean, think how many books with the general premise "girl meets guy, girl can't have guy, girl comes up with a way around the problems and they live happily ever after" get published every year. You can use any general idea for a book - it's directly taking characters, place names, etc that's illegal. So as long as your kids aren't named Harry, Ron or Hermione and they aren't going to Hogwarts, you should be just fine. :)

It's not "illegal" -- but you're going to have to be very careful with your story. An idea itself cannot be copyrighted, but you will get called out for plagiarism if you don't make your idea original. Harry Potter is very popular; and so many people are going to be comparing it to JK Rowling's work.

JK Rowling does not "own" the wizard school idea; it's free for anyone to use.
Your biggest problem is going to be trying to come up with a twist to make it different from Harry Potter.

    Good luck.

It's not illegal, but it will inevitably be compared to Harry Potter. To which, I'm sorry, there can be no comparison. Write it if you want to and see what happens, but don't use any similar characters or conflicts. Good luck!
