Hi I'm from South Africa, Gauteng and havea question regarding traffic fines.?

I have just received a FINAL NOTICE for a fine (R300) dating back to 2007/06/13 which was from my move from Cape Town to Gauteng. Is it legal for

them to mail me 2 years later with a final notice warning since I have never previously received the fine.

Secondly they are not sending me an SMS of another fine (R2300) which is surely not legal as I have never received notice of the other fine either

other than an SMS - is an SMS 2 years later legal as a way of administering final warnings.

I dont feel that eaither of these fines should be payed although I did pay the first one as it was a silly amount but surely I should not have even payed either fine?

    It depends un numerous things. The first thing would be to determine if it was a 341 notice or a 54 notice.

    If you never received the first notice (SO, they did not hand a traffic fine to you on it with a date for a court appearance0, then technically you can ignore ALL other notices, save one which is handed to you personally, or sent to you by registered mail and for which you signed.
    legally you do not have to do anything.

    The problem is, that if you are caught in ANY roadblock, then they are entitled to make you wait while they issue the fine; which you will then have to pay or appear in court.

    Eventually you will have to pay the fine, the question is simply if you want toi pay it now or will take the chance to be caught in a road block when you might be on your way to an important meeting.

    I agree with Roger C get a professional to help you with that, But i don't think the fines is legal.

    You should get some expert advice .... remember the demerit point system is also in working now on the new AARTO System and you only have 32 days to pay the 50% reduced amount, or it will go back to the original amount plus a R60.00 penalty
