Do It Yourself Divorce?

Can you file a Do It Yourself divorce if you live in a different state than your legally separated spouse? If so, do you file in the state in which you got married or in the state in which you now live? Thanks!

Yes, and a second yes provided that you've met residency requirements where you live now. Contact the Family Court clerk and see if the clock starts ticking on the day you file, or if you can show by an apartment lease, for example, that you've been separated for awhile, can it be retroactive to the "date" of separation? You have nothing to lose.

When there are no children and no assets involved, the wisest thing people can do once they split up and maintain separate residences is to file for legal separation immediately. It generally takes about 18 months and in many states less, for a notice to come by mail indicating that the judgment will be finalized. The Court Clerk should be able to tell you everything you need to know.
