How can I keep the neighbors dogs out of my yard?

The neighbors dog comes into our yard to poop. Usually right infront of my daughters swing set and it actually jumped our patio fence and came all the way into our house through doggie doors.
We informed the owner and she just says that the dog annoys her and she wants to get rid of it but hasnt and still lets the dog roam free around the town.
We want to stay civil since we live next door to each other but im tired of cleaning poo off my shoe everytime I walk through our back yard.

We talked the town cop and he says he can not do anything about it inless he catches the dog off the property.

Our area of town does not allow privacy fences to be built and the dog can jump over anything 3 feet tall.

We put up an electric wire around the patio for the winter so he would not jump over and enter our house but for safety reasons we removed it when summer came. (We have a 3 year old)

How do we keep this dog off our property? Without hurting the dog or making enemies.

Keep a record book of all the times the dog has been loose. I would also suggest if you do not already own a video camera to buy one and tape the dog running loose.
I wouldn't worry about making enemies, obviously the neighbor doesn't care what her dog is doing in your yard.
